These terms govern the purchase and use of a scored analyst price-target file for a single ticker (the “File”) from anachart.store, operated by VADJ Inc., doing business as AnaChart (“AnaChart”, “we”, “us”). By ticking the acceptance box at checkout and completing payment, you (“you”, “Buyer”) agree to these terms. They supplement the anachart.store Terms of Service; where the two conflict about a File, these terms govern.
1. What is sold
1.1 One File per order. A File is a CSV containing the analyst price-target and rating events AnaChart holds for one ticker, with the outcome columns described on the product page, as of the date shown in the File.
1.2 Eligible tickers. The File is available for the tickers on the list published at anachart.store/ticker-file/ on the date of purchase (current constituents of the S&P 500 and the Nasdaq-100). An order for any other ticker is not fulfilled as a File; AnaChart will refund the payment in full or, at Buyer’s election, quote a custom data cut under separate terms.
1.3 Delivery. The File is delivered as a download link sent to the email address given at checkout, normally within minutes for prepared tickers and within one business day otherwise. The link is personal to the Buyer.
2. Licence
2.1 Grant. AnaChart grants Buyer a limited, non-exclusive, non-transferable, perpetual licence to use the File for Buyer’s own internal purposes, including investment research, quantitative analysis, model development, reporting and academic research.
2.2 Restrictions. Buyer may not, without AnaChart’s prior written consent:
- (a) redistribute, resell, sublicense, publish, post or share the File, the download link, or any substantial portion of the File's records with any third party;
- (b) combine two or more Files, or a File with other AnaChart data, to assemble, reconstruct or approximate a multi-ticker dataset for distribution or for a product or service offered to others;
- (c) use the File to build, train or improve a product or service that competes with AnaChart's data products;
- (d) reverse-engineer AnaChart's scoring methodology, parser or data pipeline;
- (e) represent the File or its records as Buyer's own proprietary data;
- (f) use the File in connection with any unlawful activity.
2.3 Derivative works. Buyer may create analyses, models, charts, reports and publications derived from the File and may share or commercialise them, provided they do not reproduce a substantial portion of the File’s raw records. Attribution to AnaChart is appreciated and not required.
2.4 Ownership. The File, the underlying dataset, the scoring methodology and all associated intellectual property remain the exclusive property of AnaChart and VADJ Inc. No rights are granted other than the licence in 2.1.
3. Data sourcing and accuracy
3.1 The File is compiled from publicly available sources, including financial wire services, financial news media and broker-dealer disclosures, using AnaChart’s parser. AnaChart does not reproduce proprietary research reports and does not access material non-public information. The File contains no price feed: the outcome columns are AnaChart’s own computation against third-party end-of-day prices, and no third-party price series is included.
3.2 The File is provided as is. AnaChart makes reasonable efforts toward accuracy but does not warrant that the File is complete, accurate, current or free from errors. Records may contain parsing errors, missing rows, or dates and values that differ from other sources. The scoring columns are computed by the published method against end-of-day prices from a third-party provider and may differ from other methods. Buyer is responsible for verifying any information before relying on it.
3.3 Not investment advice. AnaChart is a data provider only and is not a registered investment adviser, broker-dealer or financial planner. Nothing in the File is a recommendation to buy, sell or hold any security, or an endorsement of any analyst or firm. Past analyst results do not indicate future results.
4. Payment and refunds
4.1 Price. The price shown at checkout, charged once, in US dollars, through AnaChart’s third-party payment processor. This is a one-time payment. No subscription is created and nothing renews. AnaChart does not store card details.
4.2 Refunds. Because the File is a digital product delivered on purchase, payment is not refundable once the download link has been sent, except: (a) where the ordered ticker is outside the eligible set (1.2); (b) where the File cannot be delivered; or (c) where the File contains no scored records. In those cases AnaChart refunds the payment in full.
4.3 Taxes. Prices exclude any sales or similar taxes that may apply, which are Buyer’s responsibility unless collected at checkout.
4.4 Refund policy. The File is a digital product delivered on purchase and is not returnable once the download link has been sent, except in the cases listed in 4.2, which are refunded in full. Contact [email protected].
5. Disclaimer of warranties
THE FILE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANACHART’S TOTAL LIABILITY ARISING FROM OR RELATED TO A FILE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID FOR THAT FILE. ANACHART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, TRADING LOSSES, LOST DATA OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Nothing in these terms limits liability that cannot be limited by law.
7. Indemnification
Buyer will indemnify and hold harmless AnaChart, VADJ Inc. and their officers, employees and agents from third-party claims, losses and expenses (including reasonable attorneys’ fees) arising from Buyer’s use of the File in breach of these terms, Buyer’s derivative works, or Buyer’s violation of law.
8. Termination
The licence in 2.1 ends automatically if Buyer breaches Section 2.2. On termination Buyer must delete the File and any copies. Sections 2.2, 2.4, 3, 5, 6, 7 and 9 survive.
9. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes are resolved exclusively in the state or federal courts in New York County, New York, and Buyer consents to their jurisdiction.
10. General
Entire agreement as to the File; AnaChart may update these terms for future purchases; a purchase is governed by the version in force when it was made; severability; no waiver by non-enforcement; Buyer may not assign; AnaChart may assign in a merger, acquisition or sale of assets.
